Suçluların Affı

Kuvvete dayanmayan adalet aciz, adalete dayanmayan kuvvet zalimdir.

Belli bir suç işlemiş insana karşı yapabileceğiniz iki şey vardır; ya ıslah edecek ya da ceza vereceksiniz. Affetmek suçla mücadele yöntemi değildir. Suç işleyenleri sürekli affetmek insanları ancak suça teşvik eder.

Türkiye'de 2002 yılına kadar 55 tane af çıkarılmış. Geçtiğimiz koalisyon hükümeti döneminde “Rahşan Affı” diye tarihe geçen af sırasında sadece 11.800 tane PKK’lı aftan yararlanarak tahliye oldu ve bunların hepsi dağa geri döndü. Bunlardan başka aynı aftan yararlanarak tahliye olan binlerce katil, hırsız, tecavüzcü, dolandırıcı ise sokaklara geri dönerek suç işlemeye devam etti.

Hiç şüphesiz Rahşan Ecevit af teklifi ile gündeme geldiğinde bu sonucu beklemiyordu. Kendisi konunun uzmanlarınca “kişiye özel af olmaz, bu genel affa dönüşür” diye defalarca uyarıldığı halde O, “baklava çalan çocukları” affedebilmek amacıyla bu afta ısrar etti. Sonuç tam bir rezaletti. Aftan yararlanarak tahliye olmuş tecavüz hükümlüleri tekrar çocuklara tecavüz ettiler, hırsızlar tekrar hırsızlık yaptılar, katiller tekrar öldürdüler ve cezaevleri tekrar doldu.

Af teklifi ile gündeme gelenlerin bu konuyu bir kez daha düşünmesi lazım. Benim yedi yaşındaki yeğenim, suç işlemeyi adet haline getirmiş 14 yaşındaki bir hırsız tarafından evinde öldürüldü. Sonra bu hırsız ve katil iki sene sonra çocuk diye tahliye edildi. Çıkar çıkmaz başka birini bıçakladı, sonra tekrar cezaevi, tekrar af, tekrar suç, tekrar cezaevi, tekrar salıverilme bu böyle sürüp gitti…

Asla ıslah olmadı.

Kanunlar önünde çocuktu, ama tetiği çekip, bıçaklayıp öldürdükleri insandı.

Her şeyi bildiğini zanneden politikacılarımıza tekrar hatırlatmakta fayda var; kişiye özel af olmaz. Af kelimesini ağzınıza aldınız mı bu genel affa dönüşür ve sonuç daima rezalet olmuştur.

Eğer cezaevleri kalabalık diyorsanız bunun hal çaresi mahkemelerin daha çabuk karar vermesini sağlayacak tedbirleri almaktır. Halen cezaevindeki insanların yarıdan fazlasını tutuklular oluşturmaktadır. Bu utanılacak bir durumdur. İnsanları hüküm vermeden aylarca, yıllarca hapiste tutmak hukuk devleti olduğunu dilinden düşürmeyen bir devleti komik duruma düşürmektedir.

Yok, eğer amacınız hapishanelerdeki doluluk oranları değil de gerçekten çocukların affedilmesi ise bunu genel af yolu ile değil kanunlarda yapacağınız düzenlemelerle hâkime yetki vererek yapabilirsiniz.

Yoksa çocuk affı diyerek yola çıkarsanız sonuçta bir bakarsınız başı kesilerek öldürülen Münevver’in katili, 2 yaşındaki kız çocuklarına tecavüz edenler ve bunun gibiler serbest bırakılmış.

Kader kurbanlarını kurtarmak ve topluma kazandırmak istiyorsanız bunun yolu af değil kanuni ve sosyal düzenlemeler yapmaktır.

Benim oğlumu, yeğenimi, kızımı tecavüz edip öldürenleri affetmek yetkisi sizde değildir. Kanunları bu yöntemle sürekli işlemez hale getirirseniz namuslu insanlara kendi kanunlarını kanla yazma hakkı vermiş olursunuz.
